DEPOSITS:

A non-refundable deposit amount of $250 is required for all dogs. The deposit is non-refundable for any reason except if there are no live pups born in the litter, or the required sex is not available. Deposits are taken on a first come, first served basis. The buyer is notified of the order in which their deposit is received.

SELLERS AGREEMENT:

1. Punkin Head Bordeaux shall be the registered co-owners of the Dog/Bitch Yes______ No______
   
2. Punkin' Head Bordeaux will retain breeding/stud rights to the Dog/Bitch Yes______ No______ Terms______________________
   
3. Seller guarantees this pup to be in good health at time of sale - all puppies are sold with a record of inoculations, and is supplied to the purchaser upon completion of sale. All puppies are permanently identified with AVID Microchips. All puppies are warranted to be in good health at the time of sale (subject to any health problems or defects the purchaser agrees to accept:___________________________________). Any claims to contagious or infectious diseases must be supported by a signed veterinarian's letter with such letter obtained at the purchasers expense within 14 (fourteen) days of the date of the sale. Any claims for congential or Herditary defects, not due to the purchaser's neglect or mistreatment of the puppy, when sold must be supported by a signed veterinarian's letter with such letter obtained at the purchasers expense and produced to Punkin Head within twelve (12) months of the date of sale.
   
4. Show prospects are just that, "PROSPECTS" The seller has no way of insuring that buyer will give proper training and care to yield a Champion.
   
5. Seller does guarantee this pup to be free from any congenial defects which would prevent this Dog/Bitch from obtaining a championship if it is sold as a show prospect
   
6. Seller guarantees this Dog/Bitch free from any life threatening congenital and genetic defects and crippling (meaning the dog is unable to walk and proceed with a normal quality of life) hip dysplasia for a one year period from date of purchase (Punkin Head Bordeaux does not guarantee against any other form of Hip Dysplasia including mild, moderate or severe). See #10 for fulfillment requirements.
   
7. Any dog requiring euthanasia for such a defect will be replaced with the next available applicable dog of the sellers satisfaction. Replacements may take up to and over two years. See #10 for fulfillment requirements.
   
8. All registration papers will be returned to the seller before replacement is given
   
9. SHOW PROSPECTS - If a severe disqualifying fault should develop in the first two years the Dog/Bitch must be spayed/neutered at the buyers expense. Buyer will retain first Dog/Bitch. See # 10 for fulfillment requirements.
   
10. For Punkin Head to fulfill this warranty against crippling hip dysplasia, the dog must be Penn Hip certified and the results given to Punkin Head along with a letter from a qualified veterinarian stating that the dog has crippling hip dysplasia (if the animal referred to herein develops this condition up to 12 months from the date of sale) obtained at the PURCHASERS EXPENSE.
    Punkin Head Bordeaux refers to CRIPPLING HIP DYSPLASIA as a condition which impeads the dogs movement in the manner where it must be assisted to rise, walk, releive itself, and that a panel of veterinarians agree that the dog should be euthanzied for humane reasons. Punkin Head Bordeaux does not guarantee against any other form of Hip Dysplasia including mild, moderate or severe.
    
    Punkn Head will provide a replacement puppy as soon as one becomes available. The purchaser has the option of: Retaining the dog, returning the dog to Punkin Head, or euthanizing the dog (with the input and guidance of Punkin Head). For Punkin Head to fulfill its warranty against any other congenital and genetic defects, all claims must be supported by a signed veterinarians letter obtained at the purchasers expense (if the animal referred to here develops a condition up to 12 months from date of purchase).
    
    For a disqualifying fault, a statement from two expert judges must be obtained and the dog must be evaluated by Punkin Head. All medical care of any congenial, hereditary, or hip dysplaisa will be the responsibility of the purchaser. If the dog is in question of having a congenital or hereditary defect, Punkin Head must be contacted immediately PRIOR to any measures of care, euthanasia, etc. (unless an emergency situation). Before any replacement is given, a veterinary spay/neuter certificate stating that the dog has been rendered incapable of reproducing must be received by Punkin Head.
    
    Although we have not had Demodex Mange in our puppies or adults, Punkin Head Bordeaux does not guarantee against LOCALIZED DEMODEX manage for SHOW PROSPECT OR PET QUALTY. If a dog sold as a SHOW PROSPECT develops GENERALIZED Demodex manage within 24 months of age and it has not been bred (regardless of producing puppies or not) or studded (reglardless of producing puppies or not), a replacement Show Prospect dog will be given with the next available litter if there are show prospects in that litter, of the same sex that is being replaced. A certificate of spay/neuter must be submitted to PHB within 3 months of the Generalized Demodex mange outbreak to be vaild and the dog must have never been bred. If a dog is bred prior to a Generalized Outbreak, no replacement will be given. All veterinary care of affected dog is the responsibility of the owner.
    
    As we are not a "big breeder" and do not have multiple females to breed, it can take up to or over two years for a suitable replacement dog to be produced. We cannot guarantee a time frame for a replacement dog.
    
    BUYERS AGREEMENT:
    
    1. I agree to have pup examined by a qualified veterinarian within 14 days of receipt
    2. I agree to give proper veterinary care, proper diet (nourishment), housing, and make all reasonable efforts to keep this dog in good health
    3. I agree not to resell the dog to pet wholesales, pet stores, research, dog brokers, etc., or to sell its offspring to such.
    4. I agree, that at any time during the life of the dog, if I cannot keep or house it, I will contact Punkin' Head Bordeaux of the situation to have first rights to find a suitable home for the dog, or place it in rescue if necessary at no cost to the breeder or rescue.
    5. I agree not to transfer primary ownership of the Dog/Bitch without first notifying Punkin' Head Bordeaux
    6. I agree to assume responsible for maintaining all veterinary care of the Dog/Bitch

    REGISTRATION
    
    Punkin' Head Bordeaux will supply the buyer with AKC FSS (AKC Foundation Stock Service) paperwork on all dogs. Pet Quality dogs will receive LIMITED registration. Buyer agrees to supply Punkin' Head Bordeaux of copy of registration upon receipt for their records.

    PET QUALITY

    1. I agree to have pup neutered/spayed between 6-12 months of age
    2. I understand that no registration papers will be given
    3. I agree not to breed this Dog/Bitch

    SHOW PROSPECTS
    1. I agree not to breed this dog before two years of age.
    2. I agree not to breed this dog until my non-breeding agreement has been fulfilled
    3. I agree to use only another show/breeding quality dog to breed to (no visible disqualifying faults, or known faults)
    4. I will make all attempts possible to Champion this dog before it is bred or standing at stud.
    5. I agree not to spay/neuter the dog without the knowledge of Punkin' Head Bordeaux for any reason.
    6. I agree to show this dog at all possible events for conformation to obtain its championship.
    7. I agree to temperament test this dog
    8. I agree to Penn Hip or OFA Hip screen this dog
    9. I agree to do all necessary health screenings on this dog prior to breeding
    10. Punkin' Head Bordeaux will show the dog for the buyer Yes______ No_______ Terms_____________________

    The terms in this contract are binding and non-negotiable, and are subject to change at any time prior to finalization by both parties.

    "Proper veterinary care" refers to, but not limited to, inoculations, internal as well as external parasites, preventatives.

    Violations of the contract shall entitle Punkin Head to two thousand dollars ($3000) in liquidated damages, and or the seizure of the above named dogue de bordeaux, with or without the presence of the police or Humane Society, which ever the situation dictates.

    I am in full understanding of this agreement and contract. Any violation of the above and the seller will take possession of said dog and buyer will not receive a refund of any moneys paid or expenses. I agree to all the terms stated in the above contract
